Carl and Selma have been married for 5 year. They live together in a house in London which they purchased together 3 years ago. The house cost £350,000, of which Carl provided £50,000, Selma provided £20,000 and the remaining £280,000 was gained be a mortgage in Carl’s name alone because Selma was not working at the time. The house was also registered in Cal’s sole name. Carl said to Selma when they purchased the house ‘don’t bother yourself about the legal stuff-we can put you on the title when you start to earn some money’.
Selma started working shortly after this in a good job and paid some of the mortgage payments. She also paid for the majority of the household expenses. Carl was from a wealthy family and did not need to work- he spent most of his time building handmade furniture in the shed, which he sold for a modest profit.
Carl and Selma have good friends who live nearby, Lenny and Patty, who have been in a relationship for 12 years and have four children aged between 2 and 10. They are not married. Shortly after they met Lenny and Patty moved into a flat which was mortgaged in Lenny’s name alone, and his was the only name on the legal title. Petty has had a few part-time jobs but most of her time has been taken up looking after her family and the flat.
One evening, the two couples go to a nightclub together. Carl spends too much time talking to Patty and dancing with her which upsets both Selma and Lenny. They all have a big argument, and Carl and Lenny have a fight outside the club in which Lenny is seriously hurt.
Following this, Lenny leaves Patty as he is disgusted with her flirtation with Carl. Similarly, Selma tells Carl she is leaving him and moving away.
Both Selma and Patty want to know about their share in their respective homes. Selma is concerned that she was never put on the legal title. Patty is insistent that the 12 years she has spent with Lenny should count for something.
