International Commercial Law – Problem solving custom essay

[meteor_slideshow slideshow=”arp1″]

Aussie Super Cruises Ltd (ASC) with its place of business in Perth, Australia is an operator of 10 luxury cruise ships. The company?s Board of Directors decided to replace engines on 5 of their cruise ships in order to improve the overall performance of its fleet. On 5 May 2012, ASC sent the order form to Best Maritime Builders Ltd (BMB) located in Tokyo, Japan.

The order form specified that ASC wanted to buy five (5) engines and specified the engine type and model number. The order form did not state the price, but instead referred to the ?price listed on the website?. The order form also stated ?FOB Perth, Incoterms 2010?.

On 18 May 2012, BMB replied by fax ?We accept your order of 5 May 2012 and advise that the total contract price is US$2,050,000; the price of each engine being US$290,000 and the rest for the costs of installation and maintenance services for a period of 12 months from the date of installation?. ASC replied by fax later on the same day ?We agree to your conditions and would like to go ahead with our order.?

Shortly after installation of new engines it was evident that while the engines complied with minimum international standards, their performance did not meet ASC?s expectations and only improved the performance of boats by 70% (not 90% as expected). The Board of Directors was very disappointed with the performance of the engines.

Under the rules of private international law in Japan, the proper law for international sales of goods is the law of the country where the contract is performed. The Sale of Good legislation in Western Australia (a State of Australia where Perth is located) says that the Courts of Western Australia only have jurisdiction to hear matters where the contract was concluded in Australia.

The Managing Director of ASC comes to you for advice. He specifically wants to know:

? Is there a contract? If yes, when and where was it formed?
? Will CISG apply to the above transaction? Why?
? What courses of action are available to ASC in relation to the engines, what available remedies (if any) are there, and what potential defences are available to the other party?

Advise the Managing Director of ASC on these and any other matters you think relevant.

Marking Criteria (Problem-Solving Questions)

This category of specific assessment guidelines applies to problem-type questions. Assessment of this kind will be the most commonly encountered assessment in law units. Typically it will take the form of a hypothetical fact situation, where you will be asked to advise X or Y, and to identify and explain the legal arguments and options which are available.
Part B questions will be evaluated on the following criteria/factors:

? Communication ? Correct syntax, grammar and spelling, clarity of thought and expression, conformity with prescribed word limit.

? Demonstrated knowledge of the law and familiarity with relevant literature and readings ? reflects a good knowledge of the relevant legislation and relevant case law, an understanding of their scope and operation.

? Analytical skills, discussion and argument ? identification, discussion and analysis of relevant arguments and evidence, dealing with evidence and arguments in a logical, coherent structure, reaching conclusion.

? Presentation ? correct use of citations, conformity with relevant style guide, layout out, clarity, ease of reading.

Please note that the criteria listed are not necessarily of equal weighting, nor are they all inclusive. The weighting for each criterion is a matter for the academic judgement of the lecturer in charge of the unit. However, all papers are expected to have a significant weighting for written communication skills.
Citing or referencing is the process of acknowledging the words, ideas or data of others used in the preparation of an assessment. This is important to allow the readers of your work to locate and check each source of information and importantly to avoid plagiarism.

USEFUL TIPS:
? DON?T RESTATE THE FACTS ? The facts are given in the assignment question. I know them, so it is not necessary to restate the facts.

? DON?T EXCEED PRESCRIBED WORD LIMIT ? You are generally allowed to go over by about 10%, but you will be penalised if you substantially exceed the world limit. Your world limit is 1200 words.

? AVOID THE USE OF BULLET POINTS ? Your answer should be structured in sentences and paragraphs instead of bullet points.

? READ QUESTIONS CAREFULLY ? Please read questions carefully and remember to answer all questions.

? FOLLOW THE PRESCRIBED STYLE AND REFERENCING GUIDE: Footnotes system according to the legal reference guidelines.

? RESEARCH MATERIALS/SOURCES ? It is recommended that you undertake additional research (beyond material provided in the Study Guide) to answer the exam questions.

Biomechanics custom essay

[meteor_slideshow slideshow=”arp1″]

For this week’s discussion, find a video of an athlete performing a skill. provide an anlysis of the individual’s performance. DO NOT use an olympic/elite athlete for this discussion board. Try to find a video where the performance is not perfect. A “perfect” performance will not allow you to discuss what the athlete can do to improve the performance.

I have chosen a video on tennis backhand volley. You can use this video or another one of your choice, as long as it is a sport video and you are able to complete the five steps below.

http://www.youtube.com/watch?v=YB4C-sm-kRA

• Step 1: Observe the complete skill.
• Step 2: Analyze each phase and its key elements.
• Step 3: Use your knowledge of sport mechanics
in your analysis.
• Step 4: Select errors to be corrected.
• Step 5: Decide on appropriate methods for the
correction of errors.

Sports Psychology custom essay

[meteor_slideshow slideshow=”arp1″]

Title: Week Six Forum Goal-Setting

Anorexia nervosa is a psychological disease characterized by an intense fear of becoming obese, a disturbed and distorted body image, significant weight loss unrelated to other illness, refusal to maintain normal body weight, and amenorrhea. Bulimia is an episodic pattern of uncontrollable food bingeing followed by purging. It is characterized by awareness that the pattern is abnormal, fear of being unable to stop eating voluntarily, depressed mood, and self-deprecation. Anorexia nervosa and bulimia are the two most common eating disorders. It is difficult to get an accurate assessment of eating disorders due to under-reporting. Athletes, in particular, are very secretive because they run the risk of being dropped from the team if the problem is discovered. They will only share the problem when the problem is almost catastrophic and professional help is needed. As a coach, I have known that at least six of my athletes suffered from this self-destructive behavior.

Research demonstrates that goals are a powerful means for effecting behavior changes. Goals that directly influence behavior focus a performer’s attention on important elements, increase motivation and persistence, and facilitate the development of new learning strategies. Goals that indirectly influence behavior can alter important psychological factors, such as self-confidence, anxiety, and satisfaction.

Structure a COMPREHENSIVE goal-setting program to help an athlete overcome either disorder.

All published materials used MUST be paraphrased (restated in your own words) and source credited both in the body of and in a list at the end of each post where any content is based directly on or inspired by a published author’s writing. APA referencing format is required

Each week you must incorporate into and apply 3 idea/concepts from the week’s assigned readings to your first post. This will be evidenced by clear identification of the ideas/concepts so the reader can easily locate them in your post an explanation of how they fit and their pages number locations in the course textbook.

Keep in mind as you write that “incorporating” doesn’t mean just tacking onto the end or randomly placing so you can say you did it. The ideas/concepts must be logically placed in the post in a way that fits with the flow of the rest of the writing.

CO-OPERATIVE EDUCATION custom essay

[meteor_slideshow slideshow=”arp1″]

You should also make sure that you have addressed all the areas that are set out in the marking criteria. Below is some additional information which may be of assistance.

The Co-op Report is the culmination of your semester?s work in Co-op. As with the rest of the assessment programme, it focuses on the BBus Learning Goals and is designed to measure your achievements in these Learning Goals at the exit point of your BBus.

Each of the BBus Learning Goals were set out in the Learning Framework and you continued to develop and reflect on these in your Progress Reports. The Co-op Report requires you to demonstrate that you have competency in each goal by addressing the following:

Learning Goal 1: Be self-directed, reflective learners:
Demonstrate your ability to be reflective, self-directed learners

Learning Goal 2: Be knowledgeable in their major field of study:
Demonstrate your understanding of key concepts and theory in your field of study

Learning Goal 3: * Be critical enquirers and problem solver:
Demonstrate analysis, evaluation and critical thinking

Learning Goal 4: Be able to think and act ethically:
Demonstrate your understanding of ethical and social responsibility issues facing business and society

Learning Goal 5: Be able to work collaboratively:
Demonstrate your ability to work with others

Learning Goal 6: Be effective communicators (written):
Demonstrate effective written communication. This goal is assessed on your writing and report format and does not need to be addressed in a separate section

The Co-op Report requires you to demonstrate that you have developed competency in the BBus Learning Goals by carrying out the critical analysis and evaluation set out above for each of Learning Goals. You need to support your analysis throughout the Report by integrating the models, frameworks, theories and/or technical competencies.

In the Learning Framework you were effectively asked to provide a ?snapshot? of where your thinking was at in relation to each of the Goals. The two Progress Reports have asked questions which were designed to track your progress in gathering information to help you to be able to achieve the five goals set out above.
Therefore you need to draw on what you have done in the Progress Reports to complete the critical reflection, identification, analysis and evaluation required. However you should not be cutting and pasting from the reports.
*See separate resources for integrating LG 3.3 into your report
Material discussed in the Workshops
In the workshops there was discussion about the process you have already completed through completion of the Progress Reports, and what is required in the Report.

There was also discussion about identification, analysis and evaluation. Students were referred to the following diagram to explain the process they have been undertaking and where the Co-op Report fits in.

In this diagram ?Action? is what you have been doing in your job. ?Reflection in action? refers to situations where you are doing your job but something comes up so you reflect instinctively and change your behaviour. McGill and Brockbank (2003) give the example of trying to hang a door, running into problems and solving the problem by using a lever to assist.
?Reflection on action? is what you have been doing in your Progress Reports. This is where you have been asked to look back at what you did at work and ask yourself why? how? What are the different perspectives? What models, frameworks, theories and/or technical competencies are relevant here? This is the critical analysis that you should have been doing in the Progress Reports. Therefore if you have completed your Progress Reports comprehensively and related models, frameworks, theories and/or technical competencies throughout your reflection, most of your critical analysis should have been done.
The final part of the Co-op Report is represented by the outer circle ? ?Reflection on reflection?. You are being asked to step back and reflect on your Progress Reports. What conclusions can you draw ? what went well, what went badly. What would you change and why? This is the evaluation.
In the Report you need to include enough description of the ?Action? to set the scene ?. But keep this brief. Most of your report should be drawing on the analysis you have already done and your evaluation of the experience. Make sure that all the way through your analysis is supported by theory and examples.

Some practical matters:
You need to format your Co-op Report as a Business Report.
You should have:
? Cover Page
? Executive Summary
? Table of Contents
? Introduction
? Main Body of Report should be in two sections-
o Section One for LG2, 3.1,3.2, 4 and 5 (LG1 & 6 are marked on your reflection and your written communication)
 Discussion
 Conclusion
o Section Two covering LG3.3- Your Research Topic
 Discussion
 Conclusion
 Recommendations for Section 2 if appropriate
? Reference List in APA style (and your report must be correctly referenced throughout)
? Appendices are not required unless there is something relevant you think should be included.
Although normally in a Business Report you would not use the first person (?I?) it will be necessary to do so in the reflective section of the Co-op Report.
If you want to refresh yourself about Report writing you should look at:
Emerson, L. (Ed.). (2005). Writing guidelines for business students (3rd ed.). Melbourne, Victoria: Thompson Dunmore Press.
*See separate resources for integrating LG 3.3 into your report
Reference list:
Brookbank, A. and McGill, I. (2003). The Action Learning Handbook. London: Routledge Falmer.

The Co-op Report
Co-operative Education is the capstone of your academic study in which you bring together everything you have learned from your first year papers your major discipline papers and any elective papers you have studied. For many of you it marks the end of your degree study and the beginning of the next phase of your learning journey as confident and capable BBus graduates. The Co-op Report is your opportunity to demonstrate your ability to write an excellent business report and demonstrate your competency in the BBus Learning Goals. Below are some suggestions about how you might approach writing your Co-op Report.
How?
The language of your Co-op Report
The structure of your Co-op Report
Getting ready to write  Ensure you understand requirements outlined in the Marking Rubric
Material/Co-op Report)
 Review everything you know about the features of an excellent business report. Which features are appropriate for your Co-op Report? How will you incorporate those features into your Co-op Report? (Go to AUTonline/Course Materials/Co-op Report)
 Plan your Co-op Report carefully BEFORE you start to write ? be clear about what you want to say about your CP
 Structure your Co-op Report as a business report ? Cover Sheet, Executive Summary, Introduction, Discussion (Section 1 & 2), Conclusion (Section 1 & 2), Recommendations (Section 2), and Reference List. Appendices (only if relevant and are key and discussed in your Report)
 The focus of your Co-op Report writing is analysis and evaluation supported by models, frameworks, theories and/or technical competencies. Your writing must move beyond merely reporting facts and describing events. Write in greater depth about your topics.
 It is acceptable to write your Co-op Report (Section 1) in the first person because of its reflective nature
 Write in your own words and provide in-text references
 Remember the 8000-10000 word limit
 Edit, edit, edit ? grammar, spelling, accuracy, coherence, meets criteria referencing
To Whom?
The reader of your Co-op Report
 The assessor plus moderation
