Part B requires you to write a plan that you could use to answer a problem question on formation of contract. I do not want to see a full text detailed answer – just a well structured plan that follows the sort of structure that I have spoken of a number of times in seminars. I suggest you use headings to indicate your introduction, each of your paragraphs and conclusion. Use no more than 250 words – or else your answer will look less like an answer plan and more like a full text answer. I shall be looking for evidence of the use of deductive logic and the use of case law authority in support.
Part B.
Bob the builder, as an act of kindness, repaired the leaking roof of his next door neighbour Arthur, while Arthur was on holiday. Bob employed Wendy to help him with Arthur`s roof, agreeing to pay Wendy £60 per day. Bob met with Mohammed, the landlord of Bob`s builders yard, when he went to pick up some materials to do Wendy`s roof, and Bob asked Mohammed whether the rent on the builders yard could be reduced from £300 to £150 per month for six months due to cash flow problems.
When Arthur returned from holiday he was so pleased with his repaired roof that he promised to pay Bob £1,000, but this payment has never been made. Whilst working on Arthur`s roof, Bob promised Wendy an additional £100 for working in the rain for three days in order that the job could be finished before Arthur returned from holiday, but at the end of the job Bob could not afford to pay Wendy this extra money. Bob has been permitted by Mohammed to pay a reduced rent for six months.
Advise Bob as to his entitlement to be paid by Arthur, his liability to make additional payment to Wendy and his liability to Mohammed for payment of arrears of rent, now that Bob`s cash flow problems have greatly improved.
