S bought some machine tools ‘ FoB Southampton?. S arranged for the goods to be loaded on a ship bound for Sydney and three original bills of lading were issued. S agreed to sell the goods on to P CiF Sydney. While the goods were en route to Sydney P contacted S and said that he would reject the goods if they had been shipped from the United Kingdom because he hated the British. S contacted the carrier who agreed to issue a new bill of lading naming Le Havre as the port of shipment. When the goods arrived in Sydney, P?s shipping agent took delivery from the carrier, and stored them in a warehouse. P received a single Bill of lading about 10 days later by which time P had discovered that he could purchase identical goods at a much lower price.
Question 1 (30% of the marks)
P has been advised that he can reject the bill of lading because it arrived after the goods and also because he is entitled to all of the bills of lading in the set. Is this advice correct?
Question 2 (50% of the marks)
P decided to accept the bill of lading and paid the purchase price. He then discovered that the true port of shipment had been Southampton when he reads the Bill of lading carefully because while the box on the front of the bill of lading names the port of loading as Le Havre it also states that the goods were “shipped on board in Southampton in apparent good order and condition?” .What remedies does P have?
