Is legal resoning – practiced by courts, attorneys, and other members of what Friedman calls the “internal legal culture” – best described as a process of logical deduction from statutory rules and past court decisions? If not, how would you describe the nature of legal resoning?
In your answer, please engage with the ideas of at least on author – Llewellyn, Blackstone, Holmes, Nader, Beccaria, Merry – and at least one author – Hart, Fuller, Dworkin. Your answer should also consider at least two legal cases from articles as examples that substantiate your view of how legal reasoning operates in practice.
Question 2. (3 pages max)
How would you theorize the relationship between law and change in broader society – i.e. changes of a social, economic, or moral nature, such as shifts in understandings and patterns of gender or race relations, or in scientific knowledge and technological possibilities, or in the relationship between economic activities and government regulation?
Your answer should engage with the ideas at least two authors fron the articles. In selecting your authors, consider a diverse pool of candidates such as Bonsignore, Friedman, Durkheim, Tocqueville, or others. You should also consider at least two examples from the historical readings, cases and video and film that illuminate the relationship between law and change as you understand it.
