The criminal justice process involves investigation of a crime, determination of whether laws were broken, arrest and trial of suspects, and appropriate sentencing or other punishment of the offenders. For example, in the case of a sexual assault, the police would investigate the alleged crime to determine if sexual assault had occurred, seek and arrest the alleged offender, try the alleged offender in a court of law, and sentence the offender if proven guilty.
While the focus of the criminal justice process is to apprehend, adjudicate, and sentence or punish offenders, the focus of restorative justice is to meet the needs of the victim. It encourages offenders to be accountable for their actions through the obligation to repair harm to the extent possible. Integrating restorative justice principles, concepts, and values into the criminal justice process enables stakeholders—victims, offenders, and communities—to be part of fostering healing and ensuring offender accountability.
To prepare for this assignment:
Review Chapter 2 and Appendix I of the course text The Little Book of Restorative Justice. Think about the principles, concepts, and values of restorative justice.
Review the Burglary Case Study. Consider how this case would be addressed through the criminal justice process (i.e., investigation, arrest, trial, sentencing). Reflect on the degree to which the needs of the direct victim and offenders would be met through this process.
Identify at least two restorative justice principles, concepts, and/or values you might incorporate into the criminal justice process to better meet the needs of the direct victim and offenders in the case study.
Reflect on how the use of restorative justice principles, concepts, and values would affect the direct victim and offenders in this case.
