The first legislation exercise requires you to develop a certain logical progression in your basic argument. This is the logical progression using icecream as an example. Remember, you are not required to critique the wording of any particular legislation, only the concept of criminalising something. So, what if the government decided to criminalise icecream?
The first step is to consider whether or not the government has the right to criminalise icecream using liberal theory. According to liberal theory (negative), the government can only criminalise something (that is, stop you from having it) if the use of the substance causes harm to another (Mill’s harm principle). You will have to use journal articles discussing the harm principle and liberalism to demonstrate this. In order to justify the criminalisation of icecream then, you will also have to show (using empirical evidence) that icecream causes harm.
Therefore, your assessment will involve two sections. Section one is the theoretical examination of the criminalisation of marijuana. Section two will be the empirical examination of marijuana use.
