Constitutional Law custom essay

[meteor_slideshow slideshow=”arp1″]

OPTIONAL CONSTITUTIONAL LAW I EXERCISE 2012

The West Australian Newspaper?s latest opinion poll indicates that the WA Premier, Harry Hutton MLA, and his party have a slim chance of being re-elected at the next State election. At a Christmas Party cruise down the Swan River, Harry discusses the party?s election prospects with his ministerial cabinet colleagues and comes up with a plan.

The plan consists of introducing a Bill, the Legislative Assembly Seating Bill 2012 (WA), into the Legislative Assembly and having it passed in the Legislative Assembly and Legislative Council with simple majorities.

The Bill will amend s 16C(1) of the Electoral Act 1907 (WA) and s 18 of the Constitution Acts Amendment Act 1899 (WA) so that the lower house will have 50, rather than 59, electoral districts (meaning that 50, rather than 59 representatives will be returned at the next WA election).

The Bill will also make some consequential amendments including:
? amending s 16E of the Electoral Act 1907 (WA) to require the re-division into the 50 districts; and
? repealing s 16I of the Electoral Act 1907 (WA).

The Premier is worried that the Leader of the Opposition will challenge the constitutional validity of the Legislative Assembly Seating Bill 2012 (WA) in the Supreme Court of Western Australia the day the Bill is introduced into the Legislative Assembly. The Premier therefore wants to immediately rush through the WA Parliament an Electoral Procedure Bill 2012 (WA) which provides in clause 1 that:
until this provision is repealed by a majority of electors voting at a WA referendum, matters of electoral districts, electoral boundaries and any procedural challenge relating to such matters shall remain non-justiciable.

You are doing a clerkship in the Premier?s office over the summer and have been asked to prepare a brief memorandum on any constitutional obstacles to implementing these amendments and the Opposition?s prospects of successfully challenging either the Legislative Assembly Seating Bill 2012 (WA) or the Electoral Procedure Bill 2012 (WA).

Students attempting the Optional Constitutional Law I Exercise:

? are not expected to go beyond Topics 1, 2 and 3 in preparing their memorandum.
? must comply with the formatting, length and submission requirements set out below.

Assessment criteria for Constitutional Law Exercise
? Depth of understanding of the question and discussion of the relevant issues and cases it raises
? Degree to which answer demonstrates an understanding of relevant constitutional concepts and principles and supports propositions of law with appropriate authority
? Degree to which demonstrates critical reasoning and analytical skills
? Employs clear expression and is well structured
? Complies with the Australian Guide to Legal Citation for all references cited and appropriately uses footnotes
? Complies with the page length stipulated and formatting requirements
? The Constitutional Law Exercise does not need to be written in a strict essay style and can use headings and sub-headings if this helps structure the student?s answer.
? Students should ensure that they answer the question set by the Exercise and that all propositions of law are supported by appropriate authority.

Formatting of Constitutional Law Exercise
? It must not be more than 4 pages formatted to 12 point Arial font with at least 2.5cm margins and 1.5 line spacing. Footnotes included at the bottom of a page can be formatted to 10 point Arial font.
? The pages should be printed single-sided rather than double-sided.
? The page length will be strictly enforced. Any pages written beyond this length will not be marked.
? All references cited must comply with the Australian Guide to Legal Citation which is available online at: http://mulr.law.unimelb.edu.au/go/aglc No bibliography is required and footnotes alone are sufficient.
? Although case citations should be included, shortened case names can be used (provided the case is still readily identifiable from the shortened name) eg Tasmanian Dam Case (1983) 158 CLR 1.

Question
Students are to answer the following question, which concerns nuisance and trespass. There are some statutory issues regarding environmental protection in the scenario but students should ignore these and address only those matters that relate to private and public nuisance and trespass.
David has recently bought his first house where he now lives with his wife and children. The house is located on Highfield Road opposite a factory unit (situated on Highfield Road in the Edward?s Industrial estate) owned by Harrington & Nephew Ltd. in which pre-cast concrete units are manufactured. Harrington & Nephew Ltd. was recently successful in winning various contracts which have resulted in the factory operating all day and throughout the night. This has caused David and his family to lose sleep through noise from the factory operations and noise from wagons coming to and leaving the factory.
Aimee, David?s wife has developed an allergy to the dust, which is emitted from the factory and now has to use inhalers every day. The family is unable to sit out in their garden and enjoy the summer due to the dust and noise, and a rose tree which they brought with them and was given to them as a wedding present 15 years ago has now died ? a horticultural expert says it is because of how the dust is affecting the soil.
Wally, David?s son parks his car outside the house on the road and the paintwork has been damaged by chemical smuts emitted from the factory?s chimney. Wally is so incensed by this that he immediately goes round to the factory uninvited and storms into the manager?s office to give him a piece of his mind. The manager is not there and because of Wally?s attitude and general manner, the secretary insists that Wally leaves the premises immediately. Wally refuses to do so. This results in something of a scuffle and as a result a window is broken.
Advise Harrington & Nephew Ltd as to any liabilities they may have to David and his family, and any defences or remedies that may be applicable, along with any case they may have against David and/or his family.
Assessment
When assessing the above coursework the following will be taken into account:
???
Structure of answer ? logical discussion of principles.
Accurate use of English, (spelling, grammar, punctuation etc.) Clear identification and explanation of legal principles, etc Referencing of work e.g. use of cases, statute and commentators.
The application of the legal principles to the given factual situation.
Clear advice and conclusions.
Assessment criteria
Presentation (compliance with instructions 1-11 above, but especially use of English)
10%
Structure (persuasiveness/balance) 10%
Identification, discussion, explanation and application of legal principles (relevance/clarity/accuracy/completeness) 60%
References (cases/statute/commentators and compliance with Harvard) 10%.

Trailheads: Shepard’s True West custom essay

[meteor_slideshow slideshow=”arp1″]

3-4 pages, typed and double-spaced
Due on Friday, April 20th (200 points)

??Trailheads? for your essay prompt: At one point in Shepard?s True West, imploring Lee to let him accompany his brother back to the desert, Austin exclaims, ?There?s nothin? real down here, Lee! Least of all me? (59)! ?Down here? references Los Angeles, but only a couple of scenes earlier?and, just as adamantly?Austin dismissed Lee?s wilderness-driven screenplay concept: ?There?s no such thing as the West anymore? (43)! It seems for both men, neither the city nor the wilderness offers a clear sense of personal identity (Remember, on page 59, Lee also admits, I?m livin? out there [in the desert] ?cause I can?t make it here!?). Perhaps it can be argued, then, that True West is a play that dramatizes the tension of men trying to maintain identity as both city- and wilderness-living have become empty abstractions, no longer steady sources of personal representation or contentment. To deepen your readers? understanding of this ?identity crisis,? address the following objectives in whatever order you consider most effective?

Discuss the qualities you associate with Austin and Lee early in the play as well as how these chatacter traits shift and/or merge as the play progresses. What factor(s) seem to be the agent for each man?s change? As always cite and/or paraphrase corroborating examples from the drama?s ?evidence.?

Discuss what you think Shepard?s title refers to. What ?truth??even if just the authenticity of certain tensions?is revealed by the play? Again, reference specific dialogue, plot events, setting dynamics, etc. to better illustrate your reasoning.

What are we left with at the drama?s conclusion? Compare/contrast the ending of the True West to the ending of Unforgiven to deepen reader understanding of the significance of Shepard?s final scene.

Some thoughts about your ?audience? and your introduction: Assume a readership familiar with some basic thoughts about stereotypes associated with western narratives. But, they?ve only thought about this line of critique mostly within literature/film set in conventionally ?Old West? places like 19th century frontier towns, etc. (sound familiar?).
Moreover, your audience is just beginning to think about how clich?s associated with Literature of the American West (L.A.W.) may be closely linked to the psychological ?landscape? of human identity construction?and further, that contemporary perpetuation of certain clich?s may be impacted by the economic and lifestyle conditions of 21st century life. Introducing your readership to some of these ideas before you hit your Body Section would be a good idea?feel free to use any of the passages I?ve provided in lecture to help you articulate some foundational thoughts about ?identity? construction and its treatment (or, lack thereof) by L.A.W. texts.

I do have the book but how do I upload the book?
it is TRUE WEST by Sam Shepard (published Samuel French)

juvenile custom essay

[meteor_slideshow slideshow=”arp1″]

This is what is expected of us in this essay;
This assessment task is designed to assess the unit learning outcomes identified below, in particular those associated with the unit?s theme, Understanding the juvenile justice system. The specific learning outcomes that are being assessed in this task are:

1. Summarise the criminology literature relating to juvenile crime, patterns of offending and the impacts of societal responses to young people;

2. An ability to critically analyse discourses and practices deployed to control and prevent juvenile crime in Australia;
3. Demonstrated ability to apply their assessment and analysis (used above) to an evaluation of interventions for working with young people committing crimes.

Rationale
1. We want you to use criminological concepts and available research evidence to develop a better understanding of the risk factors that contribute to elevated rates of juvenile re-offending;
2. We want you to use your research to develop a critical appreciation of the positive and negative consequences of planned risk interventions designed to reduce crimogenic risk and need;
3. We want you to demonstrate an understanding of the current preferred policies and principles that guide the governance of young offenders in your analysis of interventions attempting to reduce the risk of re-offending;
4. We want to see evidence of your developing skills in appreciating the complex/cultural backgrounds that contribute to juvenile offending;
5. We want to see evidence of your developing critical skills that consider the uneven power relations between young offenders and the professionals who intervene into their lives (in particular, police officers and juvenile justice workers). This can be generally related to the in (direct) consequences of the interventions themselves, and, more specifically in terms of how representatives from the dominant culture may intervene in ways that adversely impact on others (that is, in terms of negative risk assessments premised on norms of conduct about young people, including possible intersections with race, ethnicity, class, gender, culture, sexuality or (dis)ability;

The question that has to be answered is:
Reducing the risk of offending:
Using current research evidence, identify and rank at least three of the top risks that are linked to a young person?s re-offending. Considering the juvenile justice system and its current trends, which current intervention do you think is most effective at reducing the risks of re-offending by young people?

Some of the sources we can use are but are not limited to:
