Situation 1: A charge was recently filed with the Equal Employment Opportunity Commission (EEOC) by an employee. The charge states that 2 female employees in one of the nonunion satellite offices were subject to repeated and unwelcome sexual advances by their male supervisor, who is on a work visa. The charge further states that the 2 women previously complained to the supervisor’s immediate superior, letting him know they felt uncomfortable and would like the behavior to stop. The harassment did not stop, but rather, it continued over a period of 3 months. At that point, the female employees decided that the company would not help. They decided to file a claim with the EEOC, stating they were being sexually harassed at work.

The owner is certain the company can put together a response that will clear them of the charge. She asked if you felt they had a pretty strong case. You state that you are not legal counsel for Elora Jean & Co. However, you request permission to investigate the claim before giving your thoughts on the company’s policy documentation for a legal defense.

Given your knowledge of Title VII of the Civil Rights Act, you are concerned with Elora Jean & Co.’s ability to defend the EEOC charge. You plan to engage in your own investigation into the claim to learn more about the complaints made, who had knowledge, what type of investigation was conducted (if any), and what actions were taken.
Situation 2: Elora Jean & Co. has had a period of adjustment in the past 8 months regarding the involvement of the union in the business practices within the production facility. One area that Elora Jean & Co. management has found particularly challenging is the involvement of the union with employee disciplinary actions and terminations.

The National Labor Relations Board is responsible for the investigation of unfair labor practice charges brought against a company with union representation. Elora Jean & Co. has interacted with the NLRB in the past when a charge of unfair labor practice was filed (and later dismissed). The owner is hoping to avoid any further charges.

Many governments officially support the idea of human rights for all, yet there are violations occurring around the world. Human rights violations are nothing new. Historically, human rights violations have been rooted in group exclusion. Take for example the treatment of Jewish people in Nazi Germany or the treatment of Aborigines in Australia. In each case, the excluded group was subject to human rights violations on a grand scale. Human rights violations may be wide-ranging and persistent in some places where there is ongoing warfare, poverty, and discrimination. Factors that contribute to human rights violations include politics, economics, or group conflict. When human rights violations are left unchecked, there may be long-term consequences for victims and communities.

To prepare for this Discussion:
• Review Chapters 11, 12, and 13 in your course text Universal Human Rights in Theory and Practice. Focus on issues related to human rights such as political participation, economic development, individual and group rights, and nondiscrimination. Consider how those issues also relate to human rights violations.
• Review the article, “The Contemporary Significance of International Human Rights Law”. Consider economic and political consequences for states that engage in human rights violations. (Article: Buergenthal, T. (2009). The contemporary significance of international human rights law. Leiden Journal of International Law, 22(2), 217 – 223)

U.S. Human Rights Violations

The idea that human rights are a Western conception is a topic of contemporary debate. Given the democratic ideals of human rights, it seems plausible that the concept of human rights did in fact originate in the West. The United States for example, prides itself on the fundamental principle that individual rights and freedoms of all people are to be respected and protected. Thus, it might be difficult for some Americans to think of the United States as a place where human rights violations occur. Historically, the United States has experienced periods when human rights violations occurred. These violations seemed to occur mostly as a result of minority groups being excluded. For example, think of the imprisonment of Japanese Americans after the bombing of Pearl Harbor. Given the U.S. principles of equality and due process, the international community may have perceived the United States as contradicting its founding principles.
