Business Law Case Analysis Custom Essay

[meteor_slideshow slideshow=”arp1″]

Part B requires you to write a plan that you could use to answer a problem question on formation of contract. I do not want to see a full text detailed answer – just a well structured plan that follows the sort of structure that I have spoken of a number of times in seminars. I suggest you use headings to indicate your introduction, each of your paragraphs and conclusion. Use no more than 250 words – or else your answer will look less like an answer plan and more like a full text answer. I shall be looking for evidence of the use of deductive logic and the use of case law authority in support.

Part B.

Bob the builder, as an act of kindness, repaired the leaking roof of his next door neighbour Arthur, while Arthur was on holiday. Bob employed Wendy to help him with Arthur`s roof, agreeing to pay Wendy £60 per day. Bob met with Mohammed, the landlord of Bob`s builders yard, when he went to pick up some materials to do Wendy`s roof, and Bob asked Mohammed whether the rent on the builders yard could be reduced from £300 to £150 per month for six months due to cash flow problems.

When Arthur returned from holiday he was so pleased with his repaired roof that he promised to pay Bob £1,000, but this payment has never been made. Whilst working on Arthur`s roof, Bob promised Wendy an additional £100 for working in the rain for three days in order that the job could be finished before Arthur returned from holiday, but at the end of the job Bob could not afford to pay Wendy this extra money. Bob has been permitted by Mohammed to pay a reduced rent for six months.

Advise Bob as to his entitlement to be paid by Arthur, his liability to make additional payment to Wendy and his liability to Mohammed for payment of arrears of rent, now that Bob`s cash flow problems have greatly improved.

Writing a Rhetorical Analysis Custom Essay

[meteor_slideshow slideshow=”arp1″]

For this section of our readings in Chapter 5, the topic at issue is focused on the pros and cons of merit-based college scholarships. This chapter also discussed understanding logic (deductive and inductive reasoning) and recognizing fallacies. This information will help you to identify specific aspects of either the Schmidt or Mendelson essay. In the earlier chapters, we also worked with how to present general information about a topic and the two opposing sides.

The prompt: Chose either the Schmidt or Mendelson essay, and write a rhetorical analysis of that essay in order to determine its effectiveness. The different parts of this analysis will focus on detailing:
1) the author’s introduction,
2) two of the rhetorical strategies used in the essay, and
3) the refutation (where the author addresses the opposing view and counters).
Based on this analysis, come to a conclusion about the effectiveness (or ineffectiveness or both) of the essay. (The above points are detailed on the Writing Strategy posted on Blackboard under Assignments and will be discussed in class. You can use the strategy as a check list, or follow it to structure your essay.)

Be sure to include all the above points in your analysis. Also pay attention to overall essay and paragraph structure, and edit your essay for any grammatical/mechanical errors. It would also be a good idea to meet with the tutor if you are having difficulties identifying any of the above points in the author’s essay. You may also need to review the readings in the textbook to familiarize yourself with the different terms.
LENGTH: 3 to 5 pgs TOTAL POINTS: 40
(for the workshop, be sure to have 3 pgs minimum)

GENERAL GRADING CRITERIA:
Content: Does your introduction present the general topic and include a thesis
that addresses the prompt? 6 pts.
Are all points of the rhetorical analysis included in the essay? 12 pts.
Are there adequate concrete details (references to the readings) in the
body paragraphs to substantiate and support your points? 8 pts.
Form: Does your essay have a perceivable order? Is there a beginning,
a middle, and an end? 4 pts.
Do the body paragraphs have adequate topic sentences and transitions? 6 pts.
Are mechanical/grammatical errors minimal or frequent enough to be distracting? 4 pts.
Total 40 pts.
CONNECTION TO STUDENT LEARNING OBJECTIVES
Successful papers will demonstrate the follow abilities:
1) Evaluate the arguments/claims and supporting material presented in written texts
2) Summarize and paraphrase written texts
3) Interpret, evaluate, and effectively incorporate a variety of others? texts into their own
writing to support and extend their own ideas
4) Use critical thinking strategies to evaluate public written texts
5) Format simple manuscripts (page margins, appropriate font style and size, paragraph
indentation, block style, etc.) & cite sources accurately (MLA)
6) Edit their own writing for grammar, mechanics, and usage appropriate to various
writing situations
7) Critique their own and others? texts to develop their abilities in academic writing.

Writing Strategy for Essay #1
Use this writing strategy to help focus your essay; you can use it as a check list or to structure your whole essay. Remember, you are making references only to what the author states in the essay. The prompt does not ask if you agree or disagree with the author. Also keep in mind that there are many ways to write a rhetorical analysis that may vary from this model. This outline is intended to provide the points of the prompt and to provide a template for you to organize and focus these points.

I. INTRODUCTION
* Present the main topic or subject of the essay being analyzed. Be sure to
include the two opposing sides. This will take more than one sentence.
* Establish context. State the author?s name and title of the essay, which side
the author is on, and their thesis.
* State your thesis. What will your essay focus on? Be sure to address the
whole prompt. For example: “An analysis of (the author?s) essay will
detail his introduction, two rhetorical strategies and the refutation in order
to determine its effectiveness.”

II. MIDDLE (The below points are parts – not paragraphs. Follow the below order.)
* Detail (briefly) the author?s introduction. Does he use a vignette? Be sure to
include the author?s purpose and goal (see PACES handout and overview).
* Identify the author?s thesis.
(These first two points are usually detailed in one paragraph.)
* Identify two rhetorical strategies used in the essay. Be sure to identify where
they occur in the essay (close to the beginning, middle, or near the end), and
how it helps the author present a specific point. Also include the kind of
appeal it has on the reader (ethos, pathos, logos). But don?t just say that this
is an example of pathos or logos: what kind of pathos or logos? How does it
affect the reader?
(This part of the analysis will take more than one paragraph. How
many paragraphs will depend on how much you have to say about
each strategy. For this part, do not refer to the author?s
introduction.)
* Identify where the author addresses the opposition and how it is refuted. If
this is missing from the essay, you might want to address this omission and
whether you think it weakens the argument or not. (This usually takes one
paragraph.)
* Identify the essay?s overall effectiveness. You could, for example, focus on
the strong and weak points. You could focus on the overall effectiveness of
the strategies used in the essay. You could also identify any fallacies you
find, or the type of logic being used in the essay, and how these affect the
reader. (This part will usually take more than one paragraph.)

CONCLUSION
* Bring your essay full circle. Reiterate your thesis. (Do not restate it
verbatim or summarize your points.)
* Wrap it up and end with a bang.
