Law; Legal Memerandum custom essay

[meteor_slideshow slideshow=”arp1″]

You are a young lawyer at a California law firm that specializes in litigation. Lindsay, a partner at the firm, calls you into his office and asks you to help him analyze potential claims of the firm’s new client, Andy.
Andy, a 17 year old first semester freshman male at a large private university in California, had always felt that he was a female trapped in a male body. He read a great deal about transgender identity and sexual reassignment surgery. Andy did not like his roommate, Fred, who made nasty remarks about Andy’s reading material, constantly made jokes about homosexuals, using derogatory terms, and made offensive remarks about women.
As part of trying to determine his identity, Andy decided to experiment with wearing women’s clothing. One Thursday, Andy purchased some items of women’s clothing. He returned from shopping to his dorm room. As he was closing the door behind him, he dropped the shopping bag, and some of the clothing spilled out. Fred, who was at the desk, saw the items, rolled his eyes and muttered under his breath. About 20 minutes later, Andy heard Fred on the cell, loudly telling someone, “My roommate is such a freak! I can’t believe I have to live with this freak!”
Upset, Andy went immediately to his hall R.A. He explained what had happened and asked that the R.A. speak to Fred and ask him to back off. He also asked that the R.A. help him arrange for a new roommate. The R.A. refused, telling Andy that he should speak to Fred himself, that negotiating roommate conflict was an important part of the college experience.
The next morning, Fred told Andy that he planned to “score big time” at a party and so he wouldn’t be back to the room until late Saturday evening. Andy was relieved that he would have a night without his offensive roommate, and decides that he will use the opportunity to try on some of the clothes he purchased. He does so, and dances around the room to some music, pretending he’s a woman being led on the dance floor.
Unbeknownst to Andy, Fred set up his computer to record what was going on in the room. On Saturday evening, Fred downloaded what he’d recorded and saw a video of Andy, dressed in women’s clothing dancing around the room. He posted it on YouTube, making it clear what university they both attended, labeling it “Dancing Freak Roommate.”
On Sunday morning, Andy attended chapel services, as usual, and noticed a few people looking at him, grinning and then whispering to others. After the service, one of his friends, Tina, pulled him aside and told him about the YouTube posting. Andy was horrified. That afternoon, Andy wrote to YouTube, begging them to take down the video. YouTube did, but only after a week had passed. During that week, Andy received nasty emails, was laughed at openly on campus, and received a call from his father saying that he was disgusted by the son he’d raised.
Andy was miserable and anxious. He started eating all of his meals at a local fast food restaurant, which advertised itself as offering “Food to get you through the tough times” and specialized in “comfort food” such as macaroni and cheese, bacon cheeseburgers and chocolate cake. It offered a discount to university students for its full dinners. Each dinner averaged 2500 calories, which was not mentioned in any of its promotional materials. Andy’s weight ballooned. After six months, he was diagnosed as having high blood sugar and pressure and needs medication. He is also incurring medical costs that are not covered by insurance, and his family refuses to pay so he is trying to find work to afford the treatment.
Andy has come to your firm to see if he has claims against anyone for what has happened to him. Lindsay asks you to address the following questions.
o Can Andy make a claim against Fred for intentional infliction of emotional distress? What about violation of a right of privacy?
o Can Andy make a claim against YouTube for the delay in taking down the video? What would he have to show? What defenses is YouTube likely to assert, and how strong are those defenses?
o Does Andy have any claim against the university in connection with the R.A.’s refusal to speak to Fred or help in getting a new roommate?
o Can Andy sue the fast food restaurant? Based upon what legal claims? Would the fast food restaurant have any defenses?
Your memo is due on April 18th at 11:59pm. It is to be no more than 6 pages long (double-spaced, Times New Roman, 12 point type), and citations to cases or any other sources should be included, either in text, or in footnotes or endnotes. You may refer to any of the cases assigned as readings and may treat them as accurately stating the law of California.
Additional cases, statutes and articles are posted here for this assignment and should be used in your paper.

Automotive Control System custom essay

[meteor_slideshow slideshow=”arp1″]

Write a report in the form of a guide to other students with the following parts.
Part 1: How to build a simulation of an engine and dynamometer
Explain all the steps needed to build a mathematical model in HTML5 of an engine, and show some results which confirms it works correctly. Implement all parts as accurately as you can (inertia, friction, throttle, etc). You will need to implement controls found on an engine.
Explain and show how you add a dynamometer with variable loads. Improve the graphics and make the visual appearance look like and engine-dynamometer test bed with similar controls and displays. Draw block diagrams and flowcharts of the whole system.
Part 2: How to add a control system
Add different speed-control systems and test their performance, in the following order:
(i) on/off control
(ii) on/off control with hysteresis
(iii) Proportional control
(iv) PID control
(v) Feed forward control
Use different setpoints/step changes/slopes to check your control system. The only engine input that can be altered directly is throttle. Make the “setpoint following” as accurate as possible. Draw block diagrams and flowcharts of each system. State the accuracies you achieved. Include relevant graphs. Include graphs showing how you choose the parameters. Use proportional control alone before you implement the full PID. Explain what happens with the addition of integral control. Explain why the system becomes unstable and why the steady-state error sometimes does not reduce to zero with purely proportional control. Include graphs showing your results. The reference to control theory is in Chapter 9, pages 299-303 of http://universityofbrighton.googlepages.com/control
Part 3: Implementing a drive cycle
Choose a control system based on the previous section. Implement a drive cycle so the engine follows the setpoint within limits. Describe how the controller was modified to optimise the response and show your results.
Part 4: Advanced : Add a fuel map
Add a fuel map and show the operating point of the engine at all times. Calculate and display fuel consumption.
This report should not exceed 20 pages of “writing” (plots and appendices are ok) and is worth 100% of the module. Include all code listings and tables in an appendix. The sections are weighted equally.
notes:
I have the codes of this assessment just what i need explain this codes

compare and contrast between the novel ‘The Great Gatsby’ and ‘Death of a Salesman’ by Arthur Miller. custom essay

[meteor_slideshow slideshow=”arp1″]

write a clear, structured and elaborate paper first introducing the american dream them compare and contrast between the novel ‘The Great Gatsby’ and ‘Death of a Salesman’ by Arthur Miller. Use quotations from both books to support your argument.
an very brief example for this would be the following.. although its not structured or detailed it is an example to help guide you

The American dream was derived from the United States Declaration of Independence which clearly declared that all people were created equal, and gifted with unassailable gifts that cannot in any way be altered (Guimond 16). These gifts include the very existence we have, freedom and the insatiable need for happiness. People have become disillusioned about the American dream that they think it is all about achieving things of monetary value. Wealth and ‘living the good life’ have replaced what was simply the pursuit for happiness.
In the book ‘The Great Gatsby’, Nick Carraway understands only too late how the American’s perception of the American dream has been corrupted (Fitzgerald 43). The book sheds light on the moral decadence that comes with the quest for the American Dream. People will go to the extents so as to have things like power and money; this is their American Dream. Instead of comfort and happiness, people sought after wealth. This is a success story of the American dream as Nick realizes what he is after is not the American dream and that he already had it.
The ‘Death of a Salesman’ is a play based on the American dream. Willy, the protagonist in the play is on a quest for the American Dream (Miller 34). Willy is part of the disillusioned lot that think being liked by many people and being good looking was the American Dream. He has superficial ideas about himself and ends up being disattached from reality and eventually dies without achieving his American dream. This unlike the ‘The Great Gatsby, is not a success story.
